FiveUp provides subscription-based reputation management services that help service-based businesses generate, manage, and promote customer reviews to improve their online visibility and reputation.
2. Eligibility
By using our Services, you represent that you:
Are at least 18 years of age; Have the legal authority to enter into this agreement; and Will use the Services for lawful business purposes only.
3. Account Registration
To use certain features, you may need to create an account or provide personal information (such as name, email, phone number, and payment details).
You agree to provide accurate information and keep it current.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Subscription and Billing
Our Services are offered on a recurring monthly subscription basis.
Payments are processed securely through Stripe. By subscribing, you authorize FiveUp to automatically charge your payment method each billing cycle until you cancel. Prices and service features may change, but you will be notified in advance of any material changes.
5. Cancellation Policy
You may cancel your subscription at any time by contacting [email protected] or using the cancellation option provided in your customer dashboard.
Cancellations take effect at the end of the current billing period.
You will continue to have access to your Services until that period ends.
6. Refund Policy
FiveUp offers a 30-day satisfaction guarantee for new subscriptions.
If you are not satisfied with the Service within the first 30 days of your initial payment, you may request a full refund by contacting [email protected].
After the initial 30-day period, all payments become non-refundable, including renewals and subsequent billing cycles.
Refunds will not be provided for partial months of service, unused time, or account inactivity.
7. Use of Services
You agree not to:
Use the Services for any unlawful, misleading, or fraudulent purpose. Interfere with or disrupt the operation of the website or systems. Attempt to reverse-engineer, copy, or resell any part of the FiveUp platform. Upload or share any content that infringes on intellectual property, privacy, or other rights.
FiveUp reserves the right to suspend or terminate any account violating these Terms.
8. Client Responsibilities
FiveUp’s success depends on your active participation.
You are responsible for:
Providing accurate business and contact details. Responding to leads or review opportunities generated by the Service. Complying with applicable laws and review platform policies (e.g., Google’s review guidelines).
9. Results Disclaimer
While FiveUp uses proven systems and strategies to increase your online reviews and visibility, individual results vary depending on factors such as your customer engagement, response rate, and industry competition.
FiveUp makes no guarantees of specific revenue, ranking, or review quantity outcomes.
10. Intellectual Property
All materials, tools, systems, and content provided by FiveUp—including text, graphics, software, and trademarks—remain the exclusive property of FiveUp and its licensors.
You are granted a limited, non-transferable, non-exclusive license to use these materials solely for your business’s internal purposes while subscribed.
11. Confidentiality
FiveUp agrees to keep your business data confidential and not disclose it to third parties except as required to provide Services or by law.
Likewise, you agree to keep any proprietary information about FiveUp confidential.
12. Limitation of Liability
To the fullest extent permitted by law, FiveUp, its directors, employees, and partners shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the Services, including but not limited to loss of revenue, profits, or business opportunities.
In all cases, FiveUp’s total liability shall not exceed the amount paid by you during the three (3) months preceding the event giving rise to the claim.
13. Indemnification
You agree to indemnify and hold harmless FiveUp and its affiliates from any claims, losses, or damages (including legal fees) resulting from your misuse of the Services or violation of these Terms.
14. Termination
FiveUp may suspend or terminate your account if you violate these Terms or engage in conduct that harms our business or reputation.
You will remain responsible for any charges incurred before termination.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec, Canada, without regard to conflict of law principles.
Any disputes will be resolved exclusively in the courts of Quebec, Canada.
16. Changes to These Terms
FiveUp may update these Terms at any time to reflect service or legal changes.
When updates occur, we will notify users by email or post a notice on our website with a revised “Last Updated” date.
